Multilateral agreement M259 concerning the carriage of damaged of defective lithium cells of batteries (UN 3090 – 3091 – 3480 – 3481)
Carriage of damaged lithium batteries or cells is permitted according to SP 661 of ADR 3.3.1, only under additional conditions defined by Competent Authorities, provided that any recommendations made by the United Nations for technical requirements for the carriage of these batteries are considered when these Competent Authorities grant their approvals.
ln December 2012, the UN sub-committee of Experts on the Transport of Dangerous Goods adopted new provisions concerning the carriage of same damaged lithium batteries which should be included in RID/ADR 2015.
The present multilateral agreement proposes to apply those provisions by anticipation. It allows to avoid multiple administrative procedures within the different contracting parties.
ln addition, at the request of some competent authorities, it is also stipulated that, when use is made of it a notification shall be sent to the relevant Competent Authorities, which shall allow to gather useful information in order to continue the work in the Un sub•committee of Experts in for clarifying issues about the transport of these item that remained unsolved.
